Riforma delle professioni: l'Anpa minaccia
di chiedere l'intervento del commissario europeo Antitrust
Neelie Kroes sull'accesso e la formazione. L'associazione
nazionale praticanti e avvocati, lo scorso 14 febbraio, con
un comunicato ha stigmatizzato il nuovo testo della proposta
di riforma presentato lo scorso 28 gennaio dal Guardasigilli,
Roberto Castelli. «Riteniamo che la proposta riporta
il comunicato vada nella direzione opposta alla liberalizzazione
delle libere professioni». La previsione di delegare
la formazione interamente alle Scuole ordinistiche, o meglio
ai diretti concorrenti nel mercato dei tirocinanti, è
inaccettabile, sostiene l'Anpa, e confligge con una politica
liberale ed aperta in tema di accesso alle professioni intellettuali.«Ribadiamo
conclude il comunicato l'assoluta contrarietà [...]
al controllo [...] da parte delle istituzioni forensi sulle
associazioni: l'unico metro di giudizio, peraltro ad oggi
poco inverato, deve essere il consenso numerico di cui i sodalizi
associativi godono tra i colleghi e non certo valutazioni
verticistiche assolutamente fuori luogo».

European Commissioner Competition
Dear Madame,
I am writing to you in my capacity of President of the A.N.P.A.
(Associazione Nazionale Praticanti e Avvocati www.anpaitalia.it)
that is the italian association representing about 60.000
trainees and young lawyers.
I know you are going to examine the italian situation as regards
the competition even in the lawyers’ field.We think that there
is no free competition.
In Italy is very difficult to pass the exam for becoming lawyers
(in many parts of Italy the percentage of successful trainees
is just 20,30 %).
For this reason more and more italian trainees go to Spain
that is the sole country in the U.E. in which not is necessary
an exam to become a lawyer.In fact hundreds of Colleagues
go to Spain to get there the "homologacion" of italian
law degree and so they can enter the "Spanish Bar Association"
as "abogados".Immediatly after they can come back
to Italy and practise the profession as UE lawyers according
to the UE directives.
Moreover it is incredible to say, but trainees pay taxes to
the Bar Councils but they can’t vote, and they can’t elect
their representatives in the Bar Councils.
The situation is getting worse, as even an institutional national
representative of the italian lawyers in an article has told
that the number of new lawyers is a “social problem” (they
would be even too many).
Now the Ministry of Education is going to reform the Italian
training system because according to us they want to oblige
the trainees to attend a course in a “Local Law School” (Scuola
di specializzazione) that will be run by the Bar Councils
and lawyer’s associations.
We think that is a way to have a greater “control” about the
numbers of new-lawyers even obliging them to pay thousands
of Euros.
I would be pleased to know if we have to prepare any documents
for you, if we have to get a meeting with you or whatever
we have to do for allowing you the best investigation about
this situation.
